By using Dearly ("the app"), you agree to these terms. If you do not agree, do not use the app.
Dearly is a parent journal and sealed letter delivery app. It allows you to write daily journal entries about your children, attach photos and videos, mark milestones, and compose sealed letters that are delivered to specified email addresses on future dates you choose.
Dearly does not require an account, username, or password. Your journal data is stored on your device and synced via your personal Apple iCloud account. You are responsible for maintaining the security of your device and iCloud account.
Dearly offers a free tier and a paid subscription ("Dearly+"). The free tier includes unlimited journal entries, one child profile, and one sealed letter. Dearly+ unlocks unlimited sealed letters, multiple child profiles, and vault backup.
Dearly+ is available as a monthly ($3.99/month) or annual ($29.99/year) auto-renewing subscription, processed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
Prices may change. We will notify you of price changes before they take effect. Price changes take effect at the start of the next subscription period following the date of the price change.
When you seal a letter, it enters a 24-hour "curing" period during which you can still edit it. After curing, the letter is permanently locked and uploaded to our delivery service. We will deliver the letter to the email address you specified on or near the delivery date you chose.
We make commercially reasonable efforts to deliver sealed letters on time, but we do not guarantee delivery on a specific date or time. Delivery depends on email infrastructure, recipient email provider policies, and the accuracy of the email address you provide. We are not liable for failed deliveries due to incorrect email addresses, spam filters, full inboxes, or email provider outages.
If you cancel your Dearly+ subscription, you may use the "Deliver All Now" feature to immediately deliver all pending sealed letters. We will never withhold or delete your sealed letters due to subscription cancellation.
You retain full ownership of all content you create in Dearly, including journal entries, sealed letters, photos, and videos. We do not claim any intellectual property rights over your content. We access your sealed letter content solely to deliver it as you directed.
You are responsible for ensuring that your content does not violate any laws or third-party rights. You agree not to use Dearly to send threatening, harassing, defamatory, or illegal content through sealed letters.
Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. In summary: journal data stays on your device and iCloud. Only sealed letter data is sent to our servers for delivery. We do not sell, share, or monetize your data.
The Vault Backup feature exports all your data (journal entries, sealed letters, photos, videos) as a ZIP archive to your device. This is your data portability guarantee. We encourage regular backups.
We strive to keep Dearly and its delivery service available, but we do not guarantee uninterrupted access. We may perform maintenance, update the app, or experience outages. We will make reasonable efforts to minimize disruption and to deliver sealed letters even during service interruptions.
You may stop using Dearly at any time by deleting the app. If you have pending sealed letters, we recommend using the Vault Backup feature or "Deliver All Now" before deleting. We may terminate or suspend access to the delivery service if you violate these terms, with reasonable notice when possible.
To the maximum extent permitted by law, Dearly and its developers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to: failed or delayed letter deliveries, loss of journal data, or any emotional distress related to letter content. Our total liability is limited to the amount you paid for Dearly+ in the 12 months preceding the claim.
Dearly is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, secure, or available at all times. We disclaim all warranties to the maximum extent permitted by law.
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Hillsborough County, Florida.
We may update these terms from time to time. If we make material changes, we will notify you through the app or via email. Continued use of the app after changes constitutes acceptance of the new terms.
